1. Provider and Scope

These Terms of Service ("Terms") govern your use of endcastradio.com (the "Platform"), operated by:

These Terms apply to all users of the Platform, including free accounts (Civilian) and paid subscribers (Survivor, Operative, Commander, Legacy), as well as purchasers of one-time digital products.

2. Description of Services

Endcast Radio is a fictional post-apocalyptic audio drama platform. Users can:

Register a free account and select a city
Submit field reports that may be featured in broadcasts
Access live reports feeds, broadcast archives, and community features
Vote on story outcomes (paid tiers)
Access daily audio briefings and exclusive video content (paid tiers)
Influence storylines and broadcast direction (higher tiers)
Purchase one-time digital products (Survival Manual e-book, Founding Operator slots)

All story content, characters, broadcasts, and scenarios on Endcast Radio are entirely fictional and for entertainment purposes only.

3. Registration and Account

3.1 To use the Platform's interactive features, you must create a free account. You must be at least 18 years of age.

3.2 You are responsible for keeping your login credentials secure. You are liable for all activity that occurs under your account.

3.3 Pseudonyms are permitted. You are not required to use your real name.

3.4 We reserve the right to suspend or delete accounts that violate these Terms, without prior notice in serious cases.

4. Membership Tiers and Pricing

The Platform offers the following membership tiers:

Annual subscriptions are available at a 20% discount compared to the monthly rate.

The features included in each tier are described on the Pricing page at endcastradio.com/pricing. We reserve the right to adjust tier features and pricing. Existing subscribers will be notified of price changes at least 30 days in advance and may cancel before the new price takes effect.

5. Payment and Billing

5.1 Payments are processed by Stripe Inc. (USA). By subscribing, you authorize recurring charges to your chosen payment method.

5.2 Subscriptions renew automatically at the end of each billing period (monthly or annual) unless cancelled before the renewal date.

5.3 All prices are shown in EUR (€). Due to the small business exemption under § 19 German VAT Act (UStG), no VAT is charged on our invoices.

5.4 Payment methods accepted include credit/debit cards, PayPal, Apple Pay, Google Pay, Link, and other locally supported methods as shown at checkout.

5.5 Failed payments may result in temporary suspension of paid features until payment is resolved.

6. Cancellation and Refunds

6.1 You may cancel your subscription at any time through your account settings or by contacting us at taegestudios@gmail.com.

6.2 Upon cancellation, your paid access continues until the end of the current billing period. No partial refunds are issued for unused time within a billing period.

6.3 Annual subscriptions cancelled within 14 days of the initial purchase will receive a full refund. After 14 days, the cancellation applies to the next renewal; no refund is issued for the current annual period.

6.4 We reserve the right to issue refunds at our discretion in exceptional circumstances (e.g. technical failure preventing access to paid content).

7. Right of Withdrawal (EU Consumers)

7.1 As an EU consumer, you generally have a 14-day right of withdrawal from distance contracts.

7.2 Exception for digital content: By completing your subscription purchase and accessing paid features (e.g. Daily Signal briefings, exclusive video content), you expressly request immediate access to digital content. You acknowledge and agree that your right of withdrawal expires upon accessing digital content, in accordance with Art. 16(m) of the EU Consumer Rights Directive.

7.3 Exception for one-time digital products (E-Book): By purchasing and downloading the Endcast Survival Manual or other digital products, you expressly request immediate delivery. Your right of withdrawal expires upon download.

7.4 To exercise a right of withdrawal where applicable, contact us at taegestudios@gmail.com within 14 days of purchase.

8. One-Time Digital Products

8.1 Endcast Survival Manual (E-Book): A one-time purchase providing permanent access to the digital PDF. The purchase price is displayed at checkout. After purchase, a download link is delivered to your email address.

8.2 Founding Operator Slot: A limited one-time purchase granting lifetime access at a fixed rate and additional benefits as described at the time of purchase. The number of available slots is limited and displayed at checkout.

8.3 Digital products are for personal use only and may not be resold, redistributed, or shared publicly.

9. Field Reports and User-Generated Content

9.1 By submitting a field report, you confirm that the content is your own original work and does not infringe any third-party rights.

9.2 You grant Octo Studios a non-exclusive, worldwide, royalty-free, perpetual license to use, display, reproduce, adapt, and read your field report in the context of Endcast Radio broadcasts, the Platform, and promotional materials.

9.3 You retain ownership of your content. The license you grant us does not affect your ownership.

9.4 We reserve the right to moderate, edit, reject, or remove any field report at our sole discretion, including but not limited to content that:

Contains hate speech, threats, or discrimination
Includes personal information of third parties
Is spam, misinformation, or off-topic
Violates applicable law

9.5 Field reports are reviewed before or after publication. We do not guarantee that every submitted report will be published or featured in a broadcast.

10. Acceptable Use

You agree not to:

Use the Platform for any unlawful purpose
Submit content that is abusive, harassing, defamatory, or harmful
Attempt to gain unauthorized access to any part of the Platform
Use automated tools (bots, scrapers) to interact with the Platform
Resell, redistribute, or commercially exploit Platform content without permission
Impersonate other users or members of the Endcast Radio team
Submit false or misleading information

Violation of these rules may result in immediate account suspension without refund.

11. Intellectual Property

11.1 All content on the Platform created by Octo Studios — including but not limited to broadcast recordings, audio scripts, character names, storylines, the Endcast Radio name, logo, and fictional universe — is the intellectual property of Andreas Taege / Octo Studios and is protected by copyright law.

11.2 You may not reproduce, distribute, or publicly perform any Platform content without prior written permission, except for personal non-commercial use.

11.3 Sharing short clips or quotes for personal social media use (e.g. sharing a broadcast on YouTube or social platforms) is permitted provided clear credit is given to Endcast Radio.

12. Availability and Changes

12.1 We strive to keep the Platform available at all times but do not guarantee uninterrupted access. Maintenance, technical issues, or circumstances beyond our control may cause temporary unavailability.

12.2 We reserve the right to modify, suspend, or discontinue any part of the Platform at any time. Where possible, we will provide reasonable notice of significant changes.

12.3 We reserve the right to change these Terms at any time. Updated Terms will be posted on the Platform with a revised date. Your continued use of the Platform after changes constitutes acceptance of the new Terms.

13. Limitation of Liability

13.1 To the extent permitted by applicable law, Octo Studios shall not be liable for indirect, incidental, special, or consequential damages arising from your use of the Platform.

13.2 Our total liability to you for any claim arising out of or relating to these Terms shall not exceed the amount you paid to us in the 3 months preceding the claim.

13.3 Nothing in these Terms limits liability for death or personal injury caused by negligence, or for fraudulent misrepresentation.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers in the EU, mandatory consumer protection provisions of your country of residence also apply.

Any disputes arising from these Terms shall be subject to the jurisdiction of the courts of Hamburg, Germany, unless mandatory law requires otherwise.

15. Dispute Resolution

The European Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr

We are not obligated to participate in dispute resolution proceedings before a consumer arbitration board, and we do not voluntarily do so.

16. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
